UTOPIA FLATS S.L. (hereinafter, the "Owner") is the entity responsible for this website.

2. Purpose and activity

The purpose of this website is to present and facilitate the Owner's activity, which consists of the management and rental of holiday apartments in València. The Owner operates 14 accommodation units holding the corresponding tourism registration (VUT/VT).

Through the site, the user may, among other functionalities:

  • Learn about the accommodations and services offered.
  • Book stays through the integrated external booking engine (Guesty).
  • Purchase optional services or extras, the payment of which is handled via Stripe.
  • Access an artificial intelligence concierge assistant ("AI Concierge") during the stay.
  • Verify a booking through the dedicated portal.
  • Subscribe, where applicable, to email communications subject to prior consent.

Any processing of personal data arising from the use of these functionalities is governed by the website's Privacy Policy.

3. Terms of use of the site

Access to and use of this website confer the status of user and imply full acceptance of these terms. The user undertakes to:

  • Make diligent, correct and lawful use of the site, in accordance with the law, this Legal Notice and, where applicable, any other particular conditions that apply.
  • Not use the site for unlawful purposes, in a manner harmful to third-party rights, or in any way that may damage, disable, overload or impair the normal use of the site.
  • Provide truthful information in the site's forms and fields and keep it up to date, being responsible for its accuracy.

The Owner reserves the right to modify, suspend or discontinue, at any time and without prior notice, access to all or part of the site, as well as to update its contents and terms of use.

Regarding the booking of stays, this is carried out through the integrated booking engine (Guesty), and payment for the stay is handled by that engine or by the platform of origin of the booking. Optional extras are contracted and paid for separately through Stripe Checkout. Prices are stated in euros, with VAT included where applicable. Unless otherwise indicated, check-in is at 16:00 and check-out at 11:00; late check-out is subject to a surcharge, and entry is self-service (autonomous).

4. Intellectual and industrial property

All contents of the website —including, without limitation, texts, photographs, graphics, images, design, logos, trademarks, trade names, source code, as well as their structure and selection— are owned by the Owner or by third parties who have authorised their use, and are protected by Spanish and European Union intellectual and industrial property law.

The reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, of such contents without the express written authorisation of the Owner is prohibited. Access to the site does not grant the user any right or ownership over the contents.

Third-party trademarks, names and logos that may appear on the site (for example, those of the service providers) belong to their respective owners.

5. Exclusion and limitation of liability

The Owner takes reasonable measures to ensure that the information on the site is correct and up to date, but does not guarantee the absence of errors or the accuracy, completeness or permanent validity of the contents.

Availability. The Owner does not guarantee the uninterrupted availability and continuity of the site. To the extent permitted by law, the Owner shall not be liable for damages arising from the unavailability or interruption of the service, technical failures, or the presence of viruses or other harmful elements, notwithstanding that reasonable measures are taken to prevent them. Part of the site's infrastructure relies on technology providers (among others, web and database hosting), whose availability is beyond the Owner's direct control.

Third-party links. The site may contain links or integrations to third-party sites and services (for example, the booking engine, the payment gateway or other providers). The Owner assumes no responsibility for the contents, policies, services or availability of such third-party sites, which are managed solely by their respective owners. The inclusion of a link does not imply recommendation, association or endorsement of its content.

Use of the AI Concierge. The responses provided by the artificial intelligence concierge assistant are merely informative and indicative in nature and may contain inaccuracies. They do not constitute professional advice nor replace official information; the Owner does not guarantee the accuracy of each generated response.

The user is solely responsible for the use made of the site and for the decisions taken on the basis of the information obtained from it.

6. Data protection and cookies

The processing of users' personal data is carried out in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD), as detailed in the website's Privacy Policy.

Users may exercise their rights of access, rectification, erasure, objection, restriction of processing and portability by writing by email to info@utopiaflats.com, and may also lodge a complaint with the Spanish Data Protection Agency (AEPD, www.aepd.es).

As regards cookies, the public site does not use analytics, advertising or third-party tracking cookies. Only a technical session cookie (provider Supabase), of the httpOnly type, is used in the owner's private panel, as it is strictly necessary for its operation. The language preference is managed through the URL (/es, /en) and not by means of cookies. Because it uses exclusively strictly necessary cookies, the public site does not require a cookie consent banner.

7. Applicable law and jurisdiction

This Legal Notice and the relationship between the Owner and users are governed by Spanish law.

For the resolution of any dispute that may arise from access to or use of the website, the parties submit to the Courts and Tribunals of Spain, without prejudice to any jurisdiction that may mandatorily apply to users who qualify as consumers, in particular that of their place of residence.
