1. Identity of the provider
This website and its associated services are owned and operated by:

- Activity: management and rental of tourist apartments in València, operating 14 units, each with its corresponding tourist registration number (VUT/VT) of the Valencian Community.
Hereinafter, "Utopia Flats", "we" or "the provider". The user or guest who accesses the site or contracts the services is referred to as "the guest" or "the user".
2. Purpose and acceptance
These Terms and Conditions govern access to and use of the Utopia Flats website, the stay booking process, the purchase of optional services (extras), the use of the assistance concierge and the accommodation relationship between the guest and Utopia Flats.
Use of the site and contracting of any service imply full acceptance of these terms in the version in force at the time of contracting. If you do not agree with them, please do not use the site or contract the services.
3. Stay booking process
The stay is booked through an external booking engine embedded in the site (Guesty). It is that engine —or, where applicable, the originating platform from which the booking arrives (for example, an OTA)— that handles the booking transaction and the collection of the stay price.
Accordingly:
- Booking confirmation, availability, stay rates and their specific conditions depend on the booking engine and/or the originating platform.
- The accommodation contract is formed in accordance with the conditions shown in that engine or platform at the time of booking.
- Utopia Flats provides the accommodation, but the payment flow for the stay is not processed directly on the site's own servers; it is handled through the relevant engine/platform.
4. Purchase of optional extras
Independently of the stay booking, the guest may contract optional services (extras) —for example, late check-out, airport pick-up or welcome products— through the site.
- Payment for extras is handled via Stripe Checkout. Utopia Flats neither stores nor has access to card data: it is processed directly by Stripe, which is PCI-DSS compliant.
- Prices are stated in euros (€), with VAT included where applicable.
- The applicable price is the one shown and confirmed at the time of purchase. The purchase becomes firm once payment is confirmed by Stripe; at that point the guest receives the corresponding confirmation.
- The availability of each extra may be subject to the apartment, the date or the operational rules in force. If an extra cannot be provided, the amount paid for that extra will be refunded.
- The purchase of an extra is separate from the stay booking engine and does not modify the conditions of the stay.
5. Check-in, check-out and self check-in
- Check-in: from 4:00 p.m. (16:00).
- Check-out: until 11:00 a.m. (11:00).
- Late check-out: available for a surcharge, subject to availability and bookable as an extra.
- Self check-in: access to the apartment is autonomous (self check-in). The guest will receive the access instructions through the channels provided. The guest is responsible for safeguarding the access credentials or keys and following the instructions received.
These times may be adjusted occasionally for operational reasons; any change will be communicated to the guest.
6. House rules and guest obligations
The guest undertakes to:
- Use the apartment with due care and in accordance with its nature as tourist accommodation.
- Respect the maximum number of occupants stated in the booking.
- Not hold parties or carry out activities that cause noise or nuisance to neighbours, and respect neighbourly quiet hours and the community rules.
- Not smoke inside the apartment, unless expressly stated otherwise.
- Take care of the furniture, fixtures and fittings, and report any incident or damage immediately.
- Comply with the applicable regulations on tourist-use dwellings in the Valencian Community and provide, where applicable, the data required for the registration of travellers.
- Not use the apartment for any purpose other than accommodation (for example, subletting or commercial activity).
Damage caused by the guest or their companions may be charged to the guest. Serious breach of these rules may result in the early termination of the stay.
7. Cancellations
The conditions for cancelling and amending the stay are governed by the policy of the platform or booking engine used and by the conditions of the specific rate selected at the time of booking (for example, flexible or non-refundable rate).
The guest must review those conditions before confirming the booking. Utopia Flats does not alter the cancellation policy set by the originating platform or rate.
Extras purchased through Stripe may be cancelled or refunded depending on the nature of each service and provided they have not already been delivered; to do so, the guest may contact info@utopiaflats.com.
8. Limitation of liability
Within the limits permitted by applicable law:
- Utopia Flats is responsible for the proper provision of the accommodation as contracted, but shall not be liable for services provided by third parties (booking engine, originating platforms, payment gateway, extras providers) beyond its own involvement.
- Utopia Flats shall not be liable for interruptions, errors or temporary unavailability of the website or of the integrated third-party services (for example, the booking engine, the payment gateway or the assistance concierge).
- The assistance concierge provides indicative information to facilitate the stay; its answers may contain inaccuracies and do not constitute a binding contractual commitment.
- Utopia Flats shall not be liable for damages arising from improper use of the apartment by the guest or their companions, nor for their breach of the house rules.
- Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law (for example, in cases of wilful misconduct or gross negligence, or towards consumers under mandatory regulations).
9. Data protection
The processing of the guest's personal data is governed by the Privacy Policy of Utopia Flats, which forms an integral part of these conditions and which we recommend reading.
It details the purposes, the legal bases, the recipients (data processors), the retention periods and how to exercise the rights of access, rectification, erasure, objection, restriction and portability, as well as the right to lodge a complaint with the Spanish Data Protection Agency (AEPD, www.aepd.es). 10. Intellectual property
The contents of the website (texts, images, design, trademarks and other elements) are owned by Utopia Flats or its licensors and are protected by intellectual and industrial property regulations. Their reproduction, distribution or transformation is not authorised without express consent, except for the use strictly necessary to use the site and contract the services.
11. Amendments to the terms
Utopia Flats may amend these Terms and Conditions to adapt them to legal, technical or operational changes. The version applicable to each booking or purchase will be the one in force at the time of contracting. We recommend reviewing this document periodically.
12. Governing law and jurisdiction
These Terms and Conditions are governed by Spanish law, including, where applicable, Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 (LOPDGDD) and Law 34/2002 (LSSI-CE).
For the resolution of any dispute, the parties submit to the Courts and Tribunals of València (Spain), unless mandatory consumer protection regulations establish a different jurisdiction, in which case the latter shall prevail.
