Bicycle rental conditions

UTOPIA FLATS SL, tax ID (NIF) B19913516, registered office at C/ Serrano Morales 9, 46004 València (hereinafter, the company), offers bicycles for rent to its guests. These conditions govern each rental accepted through the website and are supplemented by the details and price shown in the corresponding booking.

Booking and acceptance on the website

The rental is identified by the booking made on the website and the details provided by the guest: person renting, assigned bicycle, accessories, price, possible deposit, place and period of use. These details will be shown before confirming and will be linked to the acceptance of these conditions.

1 Handover and condition of the bicycle

The company will hand over a bicycle in suitable condition for use and will inform the customer of its identification and the accessories provided. The company will record the condition at handover, any visible damage and, where applicable, the checks of brakes, wheels and lights; it may keep photographs. The customer will report any fault detected before setting off or as soon as they notice it. This check does not make the customer liable for pre-existing or hidden defects.

2 Use and safekeeping

The customer will use the bicycle diligently and in accordance with traffic rules. They will not hand it over to an unauthorised person, will not ride under the influence of alcohol or drugs, and will use the lock when leaving the bicycle unattended, securing it to a fixed object where possible. They will not carry out repairs or modifications without authorisation, except for urgent measures needed to prevent greater damage.

3 Damage, loss and theft

The customer will be liable for damage and losses attributable to them due to improper use, negligence or breach of these conditions. They will not be charged for normal wear and tear or for a fault caused by a prior defect, insufficient maintenance or any cause not attributable to them. The company will document the condition at handover and return, the damage and the reasonable cost of repair by means of a quote or invoice. If repair is not feasible, compensation will be calculated on the replacement value of an equivalent item, taking into account its age and condition, without enrichment of the company.

In the event of theft or loss, the customer must notify the company as soon as possible, describe the circumstances and, in the case of theft, report it to the police and hand over a copy of the report. Failure to report it could, on its own, automatically give rise to the obligation to pay the value of the bicycle.

4 Indicative amounts for attributable damage

These amounts serve as a reference for losses or damage attributable to the customer; they are not applied automatically and are not charged for normal wear and tear. If the proven cost of repair or replacement is lower, the lower amount will apply. If a part has a different price, this will be justified to the customer before any charge.

5 Accidents and third-party liability

The customer is liable for damage they cause with the bicycle when it is legally attributable to them. Traffic offences committed by the customer will be their responsibility, without prejudice to the company's legal obligations.

6 Breakdowns, assistance and emergencies

If a breakdown prevents safe riding, the customer will stop using the bicycle and notify the company. In a medical emergency, they will call 112. The customer must not order services to be charged to the insurance without prior authorisation, except in an emergency or where this is justifiably impossible. The company does not have its own collection service. The reasonable cost of return or transport will be allocated according to the cause of the incident and the cover actually available.

7 Return and incidents

The customer will return the bicycle and accessories at the place, on the day and at the time stated in the booking or subsequently agreed, and will report any incident. The company will record the condition at return and any damage observed. It will communicate any proposed charge with its justification and allow the customer to comment. The deposit, if one was stated in the booking, will be returned after the return has been checked, deducting only amounts justified under these conditions.

8 Insurance and acceptance

The company will provide the customer with information on the cover of the insurance actually taken out and its. The existence of insurance does not remove the legal responsibilities of each party, nor does it turn a risk not included in the policy into an insured one.

Before confirming the rental, the customer may consult these conditions and the essential details of the booking. By ticking the specific acceptance box and pressing the rental confirmation button, they declare that they accept them.
